KUALA LUMPUR, Dec 2 (Bernama) -- The wife of Pastor Raymond Koh has applied for her legal firm, Messrs Jerald Gomez & Associates, to be appointed as trustee to receive the more than RM31 million in damages awarded by the High Court.
The matter was conveyed by lawyer Datuk Jerald Gomez, representing Koh’s wife, Susanna Liew Sow Yoke, during case management proceedings before High Court Judge Datuk Su Tiang Joo today, which was also attended by Senior Federal Counsel Nurul Farhana Khalid, representing the government and the Royal Malaysia Police (PDRM).
The judge then fixed Dec 8 for the hearing of the application.
Earlier, Nurul Farhana informed the court that her side required time to file an affidavit in reply as they had only received the notice of application yesterday.
On Nov 5, Judge Su allowed the suit filed by Liew and ordered the government and PDRM to deposit the funds into a trustee account until Koh’s whereabouts were identified or revealed.
The sum involves general damages of RM10,000 a day from Feb 13, 2017 (the date Koh was abducted) until his whereabouts are disclosed, as well as RM1 million in damages and RM1 million in exemplary damages.
In the application filed by Liew on Nov 28, the applicant also sought for two financial institutions, PB Trustee Services Berhad and Amanah Raya Berhad, to be appointed as trustees should the court decline to appoint the legal firm as trustee.
Through a supporting affidavit, Liew, 69, said that with the agreement of her three children, Jonathan Koh Szu Hao, 41, Esther Koh Sze Ern, 40, and Elizabeth Koh Sze Wei, 29, she applied for the court to appoint Messrs Jerald Gomez as trustee to hold the trust account which would generate interest.
“Messrs Jerald Gomez & Associates have represented me and my family since 2017 during the Suhakam inquiry proceedings on my husband’s disappearance, up to now, on a pro bono basis,” she said, informing that the firm has existed since 1991, or more than 30 years.
Liew filed the suit against the police and the government over her husband’s disappearance and the manner in which the authorities investigated the case.
Koh was reported to have been abducted while he was driving by a group of masked men in Kelana Jaya, near here, on Feb 13, 2017.
