HIGH COURT SETS NOV 27 FOR BINA PURI WINDING-UP PETITION HEARING

KUALA LUMPUR, Sept 29 (Bernama) -- The High Court has set Nov 27 for the hearing of the government's petition to wind up Bina Puri Sdn Bhd, for its alleged failure to pay an outstanding income tax debt of RM4.1 million for the Assessment Year 2016.

Revenue counsel Muhammad Syafiq Muhamad Sharif, representing the Malaysian government, said the date was fixed by Shah Alam High Court judicial commissioner Datuk Raja Rozela Raja Toran during a case management session held via video conference today.

"Nov 27 has been  set for the hearing to determine whether Bina Puri will be wound up or if there will be a settlement between both parties," said Muhammad Syafiq when contacted by the media after the case proceedings.

The government, as the petitioner, filed the petition on June 23, alleging that Bina Puri owes RM4,199,439.96 in outstanding taxes for the Assessment Year 2016, including tax increases.

The tax arrears are based on the Income Tax Return Form (Borang e-C) that was self-reported by Bina Puri on Aug 30, 2017.

According to the petitioner, a Payment Demand Notice was served to Bina Puri (the respondent) on Jan 20, 2025, but the company failed to comply with the notice within 21 days of delivery.

Due to this failure, the respondent is considered unable to pay its debt under subsection 466(1)(a) of the Companies Act 2016.

As a result, the petitioner is seeking for the respondent to be wound up under subsection 465(1)(a) of the Companies Act 2016 for failing to settle its debt and has also requested the appointment of an official receiver as liquidator.
