GEORGE TOWN, Feb 26 (Bernama) -- Two directors of a furniture company pleaded not guilty at the Sessions Court here today to 58 charges of failing to pay sales tax amounting to RM320,337.84, inclusive of penalties, for the taxable period between 2019 and 2024.
Ng Eng Chen, 64, and Lim Paik Eng, 62, who were charged in their capacity as directors of Seng Cushion Sdn Bhd, entered their pleas after the charges were read out in Mandarin before Judge Irwan Suainbon.
According to the charge sheets, the company and its two directors allegedly committed offences under Section 26(5) of the Sales Tax Act 2018 (Act 806) by failing to pay sales tax amounting to RM228,812.83, along with penalties totalling RM91,525.01 imposed by the Director-General of Customs.
The offences were allegedly committed at the Registration and Revenue Management Enforcement Branch Office at the Royal Malaysian Customs Department (JKDM) Complex in Seberang Jaya between 2019 and 2024.
Upon conviction, they are liable to a fine of up to RM50,000 or imprisonment of up to three years, or both, under Section 26(9) of the same Act.
The prosecution was conducted by Royal Malaysian Customs Department prosecuting officer S. Bakialetchumy. Both accused were unrepresented.
The court fixed April 10 for mention for the submission of documents and for the appointment of counsel.
