COMPANY, TWO DIRECTORS CHARGED WITH POSSESSING COUNTERFEIT LUBRICANTS OF WELL-KNOWN TRADEMARKS

PETALING JAYA, April 1 (Bernama) -- A company and its two directors were charged in the Sessions Court here today for allegedly possessing 229 units of counterfeit car lubricants bearing well-known trademarks last year.

M Perfect Lubricant Sdn Bhd, represented by its directors Khoo Zhi Sheng, 42, and Yap Kok Lim, 43, who were also named as the persons sued (OKS), pleaded not guilty to the charges before Judge Dr Syahliza Warnoh.

According to the charges, they were found in possession of 229 units of car lubricants for commercial purposes, which were suspected of using registered trademarks without authorisation.

The offence was allegedly committed at the company’s premises in Taman Perindustrian Jaya at 11.45 am on April 29, 2025.

They were charged under Section 102(1)(c) of the Trademarks Act 2019 [Act 815], which is punishable under Section 102(1)(i) of the same Act. Upon conviction, the offence carries a fine of up to RM15,000 per item, or up to RM30,000 per item for repeat offences.

The prosecution was conducted by the Ministry of Domestic Trade and Cost of Living (KPDN) prosecuting officer Salim Wahid, while both OKS were represented by lawyer Khaw Thian Keat.

Judge Syahliza allowed bail of RM7,500 with one surety for each OKS, along with additional conditions requiring them to report to the KPDN office in Putrajaya once a month until the disposal of the case.

They were also ordered not to interfere with prosecution witnesses. The court fixed May 8 for mention.

In a separate proceeding before Sessions Court Judge Noor Ruzilawati Mohd Nor, Khoo faced a similar charge and was granted bail of RM6,000 with the same reporting conditions. The case was also set for mention on May 8.

On April 29 last year, authorities raided three premises in Ara Damansara and Kepong, suspected of bottling and distributing engine oil using counterfeit trademarks.
