ADDITIONAL DOCUMENT: GOV'T FILES NOTICE OF MOTION SEEKING LEAVE TO APPEAL TO FEDERAL COURT

KUALA LUMPUR, Feb 5 (Bernama) -- The Attorney General’s Chambers (AGC) has filed a notice of motion seeking leave to appeal to the Federal Court against the Court of Appeal’s ruling on additional documents in a case involving former Prime Minister Datuk Seri Najib Tun Razak.

In its statement, the AGC said the notice was filed yesterday, and the move is intended to ensure that all legal rights provided under the law are fully exercised.

“The decision to file this motion is based on several key premises, including conflicting interpretations of the law, as well as discrepancies between the rulings of the High Court and the Court of Appeal’s majority and minority judgments.

“This raises the need for clarity and a definitive ruling from the Federal Court. Furthermore, the legal issue at hand involves a significant constitutional matter, warranting deliberation and determination by the nation’s highest court in terms of public interest,” the statement read.

The AGC emphasised that this step is not only crucial to ensure justice but also to uphold the supremacy of the Constitution and the rule of law while clarifying legal interpretations for the benefit of all parties.

On Jan 6, in a 2-1 decision, the Court of Appeal remitted the case concerning Najib’s claim about the existence of additional documents purportedly allowing him to serve the remainder of his six-year prison sentence under house arrest, to the High Court to be heard on its merits.

Judges Datuk Azhahari Kamal Ramli and Datuk Seri Mohd Firuz Jaffril ruled in favour of the former Prime Minister, allowing his appeal to overturn the High Court’s decision that dismissed his application.

However, Judge Datuk Azizah Nawawi, who led the panel, dissented, finding that the former Prime Minister’s appeal lacked merit.
