KUALA LUMPUR, Dec 3 (Bernama) -- Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said today tabled for first reading in the Dewan Rakyat the International Settlement Agreements Resulting from Mediation Bill 2025.
She said the second reading of the Bill would take place during the next session.
The Bill seeks to give effect to the United Nations Convention on International Settlement Agreements Resulting from Mediation, which was signed by Malaysia on Aug 7, 2019
The proposed Act seeks to establish the necessary legal framework to implement the obligations under the convention and to facilitate the enforcement of international settlement agreements in Malaysia.
This will, in turn, promote the use of mediation as an effective means of resolving international commercial disputes.
The proposed Act shall not apply to certain international settlement agreements, including those concluded to resolve a dispute arising from transactions entered into for personal, family or household purposes, or those that have been approved by a court or concluded and recorded as a judgment of a court, or that are enforceable as an arbitral award.
Clause 4 seeks to provide that an application may be made to the High Court by a party to an international settlement agreement for the agreement be recorded by the High Court for the purpose of enforcing the international settlement agreement under the proposed Act.
