SOSMA IMPLEMENTATION NEEDS REFINEMENT TO UPHOLD JUSTICE, HUMAN DIGNITY - LEE LAM THYE

KUALA LUMPUR, Feb 16 (Bernama) -- The implementation of the Security Offences (Special Measures) Act (SOSMA) must be refined to ensure it upholds justice and human dignity, said Alliance For A Safe Community chairman Tan Sri Lee Lam Thye.

In a statement today, Lee emphasised the necessity of balancing national security with fundamental human rights. "While maintaining security and stability is crucial, it should not come at the expense of fundamental human rights and civil liberties," he said.

Lee expressed concerns over SOSMA's provisions, particularly the extended detention without trial, which he believes raises questions about the right to a fair hearing and access to legal representation.

He also highlighted that the presumption against bail for certain offences could lead to wrongful detentions, disproportionately affecting individuals not yet proven guilty.

"As we move forward, it is essential that any security legislation, including SOSMA, is subject to periodic review to prevent misuse and ensure alignment with international human rights standards," Lee added.

He proposed reforms such as increased judicial oversight, safeguards against prolonged detention without trial, and robust mechanisms to prevent abuse.

Lee stressed the importance of holding law enforcement agencies accountable to ensure fair application of the law without disproportionately targeting specific groups.

"Security and human rights are not mutually exclusive; they must coexist to build a just and stable society," Lee concluded.

SOSMA, was introduced as a legal framework to address national security threats, particularly those involving terrorism, organised crime, and activities that undermine public order.
