PUTRAJAYA, Oct 13 (Bernama) -- The Court of Appeal has fixed Oct 27 to hear the appeal filed by Muar member of parliament Syed Saddiq Syed Abdul Rahman and three others against the High Court’s decision to dismiss their application for leave to challenge the government’s move to withdraw allocations intended for his constituency.
Lawyer Lim Wei Jiet, representing the four applicants, confirmed the hearing date when contacted by Bernama.
Case management was conducted earlier today before Court of Appeal senior assistant registrar Ahmad Izuddin Fajri Fakrullah.
In December last year, the High Court dismissed the leave application filed by Syed Saddiq, Najib Abu Nawar, Mohd Bakirudin Abdullah and Muhamad Fadzly Bisri to commence judicial review proceedings, ruling that it had been filed out of time.
Syed Saddiq and the other three named the Prime Minister and the Government of Malaysia as respondents in their application.
They are seeking a court order to quash the government’s decision to withhold RM500,000 from a total of RM1.7 million that was supposed to be channelled directly to the Muar Parliamentary Service Centre’s bank account for welfare, community well-being and disaster relief programmes.
The applicants are also seeking to reinstate Syed Saddiq’s access to the myKHAS system, which manages the RM2 million development fund for the constituency, and to overturn the cancellation of several approved projects worth RM230,300.
In addition, they are challenging the respondents’ refusal to approve or allocate any funds to Syed Saddiq, as the Muar MP, for programmes under ‘Projek Mesra Rakyat’ or similar initiatives for 2024.
They contend that the respondents’ actions violated Syed Saddiq’s rights as Muar MP and the rights of the three voters in his constituency, as enshrined under Article 8 of the Federal Constitution.
