KUALA LUMPUR, Nov 27 (Bernama) --The Ministry of Tourism, Arts and Culture (MOTAC) today denied the viral claim that approval from the Sabah State Authority (PBN) is needed to declare heritage sites in the state as National Heritage under the National Heritage Act 2005 (Act 645).
MOTAC, in a statement, clarified that the viral information was inaccurate and did not refer to the term 'handover' as claimed in a recent video circulated by irresponsible parties.
The Ministry added that, according to Act 645, there is no such thing as an 'handover' of state sites to the Federal Government.
"Gazettement is a form of recognition and protection for the site or building under national legislation, without transferring ownership from the owner.
"This is in line with Section 69 of Act 645, which states that any National Heritage owned by someone other than the Federal Government or a state government can remain in the ownership of the original owner, guardian, or trustee," read the statement.
On Jan 2019, the Sabah government, through the State Secretary’s Office, withdrew the approval given to PBN to declare heritage sites in Sabah under Act 645. MOTAC, through the National Heritage Department (JWN), also did not proceed with the gazetting of these sites.
